Agreement to these terms
These Website Terms of Use ("Terms") govern your access to and use of wandandcompass.com and its content, forms, planning guides, and other website features (the "Site"). The Site is operated by Wand & Compass Travel Concierge LLC, doing business as Wand & Compass Travel Co. ("Wand & Compass," "we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Website information is not a booking agreement
The Site provides general information, inspiration, planning resources, and a way to contact us. Site content is not a binding offer, travel confirmation, professional legal or medical advice, or a guarantee that any price, room, sailing, itinerary, promotion, or service will be available.
Submitting a quote request, contact form, guide request, or travel-advisor application does not create an advisor-client relationship, booking, employment relationship, independent-contractor relationship, partnership, or other obligation. A travel-planning relationship begins only when the parties complete the steps and agreements required by Wand & Compass. An actual reservation is governed by the applicable client agreement, supplier terms, confirmation, invoice, and cancellation policies.
Travel information, pricing, and availability
Travel information can change quickly. Prices, promotions, schedules, routes, amenities, entry rules, health requirements, and availability may change without notice and are not guaranteed until confirmed by the applicable supplier. Images and descriptions may be representative.
You are responsible for reviewing booking confirmations promptly and notifying us of errors. You are also responsible for obtaining and carrying required passports, visas, identification, permissions, health documentation, and other travel documents, and for confirming current government and supplier requirements before departure. Guidance we provide is informational and does not replace advice from a government authority, attorney, physician, or other qualified professional.
Travel suppliers and third parties
Wand & Compass acts as an adviser and intermediary for independent travel suppliers. Airlines, cruise lines, hotels, resorts, tour operators, transportation providers, insurance companies, and other suppliers own, control, and deliver their services under their own terms. To the extent permitted by law, Wand & Compass is not responsible for a supplier's acts, omissions, insolvency, schedule changes, cancellations, service failures, or events outside our reasonable control.
Links to third-party websites are provided for convenience. We do not control those sites and do not endorse or guarantee all third-party content, products, security, or privacy practices.
Acceptable use
You agree not to:
- Use the Site for unlawful, fraudulent, abusive, or misleading purposes.
- Attempt to gain unauthorized access to the Site, its accounts, servers, or data.
- Introduce malware, overload the Site, scrape it at scale, interfere with security, or disrupt another person's use.
- Submit information that you do not have the right to provide or impersonate another person.
- Copy, republish, sell, or commercially exploit Site content or planning guides except with our written permission.
We may suspend access, remove submissions, or take other reasonable action when we believe the Site is being misused.
Intellectual property
The Site's original text, design, layout, planning guides, graphics, logos, and other materials are owned by or licensed to Wand & Compass and are protected by intellectual-property laws. You may download a planning guide for your personal, noncommercial travel planning. No other license is granted.
Names, logos, photographs, and trademarks belonging to travel suppliers and other third parties remain the property of their respective owners. References to a destination or supplier do not transfer any ownership rights.
Disclaimers
To the fullest extent permitted by law, the Site and its content are provided "as is" and "as available." We do not warrant that the Site will always be uninterrupted, error-free, secure, complete, or current. Your use of the Site and reliance on general Site content are at your own risk.
Nothing in these Terms excludes a warranty, right, or remedy that cannot lawfully be excluded.
Limitation of liability
To the fullest extent permitted by law, Wand & Compass and its owners, team members, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, opportunities, or goodwill arising from use of or inability to use the Site. Any liability connected specifically to booked travel is governed by the applicable client agreement and supplier terms.
Privacy
Our Privacy Policy explains how we handle personal information collected through the Site. By using the Site, you acknowledge those practices.
Changes, suspension, and severability
We may update the Site and these Terms from time to time. The revised Terms apply from the date posted. We may modify, suspend, or discontinue any Site feature when reasonably necessary. If a provision of these Terms is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver.
Applicable law
These Terms are governed by applicable United States federal law and the laws applicable to Wand & Compass, without regard to conflict-of-law principles. Mandatory consumer protections and rights available under applicable law remain in effect.
